Terms and Conditions of Sale and Shipping
1. Subject and scope
1.1 These general conditions of online sales (hereinafter "General Conditions") govern the purchase of food products (hereinafter "Products") made at a distance through the e-commerce platform of the website agricupido.it (hereinafter "Site"), owned by:

1.2 Agricupido observes the regulations on e-commerce (Legislative Decree No. 70/2003), as well as the provisions of the Consumer Code (Legislative Decree 206/2005 as amended).
1.3 Depending on whether the buyer is a Consumer (an individual buying for personal purposes) or a Professional (firm, corporation, or freelancer purchasing for purposes inherent in its trade or profession), the specific legal provisions and rules contained in these General Terms and Conditions will apply.
1.4 Use of the Site and purchase of the Products implies full and unreserved acceptance of these General Terms and Conditions by the user/purchaser.
2. Definitions

Buyer: any individual or legal entity that accesses the Site and purchases the Products online.

Consumer: natural person (end user) acting for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out (art. 3 Legislative Decree 206/2005).

Professional: subject (natural or legal person) who concludes the contract in the exercise of his business or professional activity, or otherwise for purposes related to the same.

User/Customer: anyone who browses the Site and/or uses its features, including those for purchasing Products.

Product(s): foods and goods offered for sale by Agricupido through its e-commerce platform.

Seller: Azienda Agrituristica Cupido di Guidarini Fabio.
3. Acceptance of the General Conditions
3.1 Before placing the purchase order, the Buyer is required to read carefully these General Conditions (available on the Site). By placing the order, he/she declares that he/she has read and accepts these conditions.
3.2 Upon completion of the purchase process, Buyer is encouraged to save or print a copy of these Terms and Conditions.
3.3 Agricupido reserves the right to amend these General Conditions at any time, it being understood that the conditions applicable to each order shall be those in effect on the date of its transmission by the Buyer.
4. Product Information and Pricing
4.1 The essential features and prices of the Products for sale are shown on the Site, in the relevant sections/products. Prices are expressed in Euros and including VAT, but do not include delivery charges, unless otherwise indicated on the Site or during the purchase process.
4.2 The images and descriptions of the Products on the Site are to be considered. purely illustrative. Actual packages may differ in appearance due to packaging changes arranged by manufacturers or for other technical reasons.
4.3 Where a Product is sold "by variable weight," the price shown on the Site refers to theunit of measurement (kg, hg, gr, etc.). The actual order amount may vary slightly depending on the final weight of the packaged Product.
5. Method of purchase and contract completion
5.1 To purchase one or more Products, the Buyer must select them and add them to the appropriate "virtual shopping cart", following the guided procedure. Before sending the order, the Buyer must read and accept these General Conditions.
5.2 The order transmitted by the Customer has the value of a contractual proposal. The sale and purchase contract shall be deemed concluded and binding on the parties when Agricupido sends the order confirmation to the e-mail address provided by the Customer or proceeds directly to execute the order.
5.3 The obligation to deliver the Products is subject to the advance payment of the relevant price by the Buyer, in the manner set forth in the "Payment Method" section set forth in Section 7.
5.4 In the event that one or more of the Products ordered are not available at the time of order fulfillment, Agricupido will promptly contact the Customer to evaluate alternative solutions (e.g., replacement with another Product or refund of the fee paid).
5.5 Agricupido reserves the right to refuse or cancel orders in the event of exceptional circumstances or obvious error (for example, material errors in the price published on the Site). In such cases, Agricupido will promptly notify the Customer and provide for the possible refund of the amount already paid.
6. Shipping and delivery charges
6.1 Deliveries are made only on Italian territory.
6.2 Shipping costs vary by weight of the Products ordered; the total amount will be automatically calculated during the purchase process and shown to the Customer before the order is confirmed.
6.3 The shipment is free for orders of amount equal to or greater than €100.00.
6.4 Delivery is made by selected couriers by Agricupido. When the order is placed, delivery time and tracking information, if available, will be provided.
6.5 Upon receipt of the Products, the Customer is required to check:

That the number of packages delivered corresponds to what is indicated in the transport document;

That the packaging is intact and undamaged;

That the Products match what was ordered (in terms of type and quantity).
In case of discrepancies, the Customer shall immediately dispute the delivery to the courier, affixing reserve control on the delivery note, and notify the Seller within 24 hours.
7. Methods of Payment
7.1 Unless otherwise provided, payment for the Products and related shipping costs may be made only by:

Bank transfer (coordinates will be provided when ordering);

Debit/credit cards via circuit NEXI (following the instructions given on the Site).
7.2 Agricupido will process the order only after receiving the bank transfer credit (or transaction confirmation, in case of credit/debit card).
8. Billing
8.1 In accordance with the regulations on electronic invoicing, Agricupido may request from the Customer the data necessary for the issuance of the tax document (Tax Code, VAT Number, SDI Unique Code, PEC, etc.).
8.2 The invoice will be issued in electronic format and transmitted to the Internal Revenue Service's Interchange System. Courtesy copy may also be sent to the Client, upon request, via e-mail.
9. Right of withdrawal
9.1 Pursuant to Article 59(d) and (e) of the Consumer Code, the right of withdrawal Is excluded for contracts having as their object the provision of perishables Or are likely to deteriorate rapidly. Since these are Food Products perishable, withdrawal is not exercisable.
10. Replacement of Products
10.1 The Purchaser may request the replacement of a Product within 24 hours From delivery, only in cases where:

a Product other than the one ordered (not in the original order) was mistakenly shipped;

the Product is incomplete of certain essential components, indicated on the Site.
10.2 In such cases, the cost of redelivery shall be borne by Agricupido, which will use a contracted express carrier. Buyer is required to contact Seller by e-mail (info@agricupido.it) to arrange shipment.
10.3 The Seller reserves the right to inspect the returned Product: if all the conditions for replacement are met, Agricupido will send the correct Product to the Customer. If the Product to be replaced is no longer available, Agricupido will refund the relevant amount, subject to the Customer's communication of the bank details.
11. Product warranties and conformity
11.1 The food information in the online catalog reflects, as far as possible, the label claims and what is required by current legislation on food information to consumers.
11.2 Agricupido guarantees the quality of food products until the time of delivery to the first carrier. Any liability of Seller for deterioration or alteration of products due to improper storage subsequent to delivery is excluded.
11.3 The Seller's liability is also excluded if the Customer has not paid attention to any allergens indicated on the Site or on the label.
12. Force majeure
12.1 Agricupido shall not be held liable for delay or failure to perform its contractual obligations due to events of force majeure, such as - but not limited to - natural disasters, pandemics, war events, strikes, power or transportation service interruptions, orders of public authorities, etc.
12.2 If a cause of force majeure persists for more than 30 days, either party may terminate the contract without right to compensation, without prejudice to obligations already accrued (e.g. refund of sums already paid for products not yet shipped).
13. Liability
13.1 Except in cases of willful misconduct or gross negligence, Agricupido shall not be liable for any loss or damage that is not an immediate and direct consequence of its own default or that was not reasonably foreseeable at the time the contract was concluded.
13.2 Agricupido shall not be liable in case of non-compliant, improper or illegal use of the Products by the Customer.
14. Applicable Law and Jurisdiction
14.1 The contract of sale between Agricupido and the Customer is concluded in Italy and governed by the Italian law.
14.2 For any dispute concerning the interpretation or execution of this contract, if the Purchaser has the status of Consumer, the Court of the place of residence or domicile of the latter, if located in the territory of the Italian State, shall have jurisdiction. In all other cases, the Court of Grosseto shall have jurisdiction.
